I would guess that it is not that ``binary''. if the sequence is a part of a (predicted) gene known to play some significant (vital) role and there is no alternative (paralog/ortholog), then there is a significant evidence that the sequence being transcribed

That's just evidence that it might be transcribed. It could also just be part of a pseudogene. That's the problem with over-reliance on computational methods.

I do agree - nothing can beat real-life experiments. Sometimes a loose evidence is all we got. Unfortunately.

That's not really doable. You need to consult empirical evidence, see if someone has measured the RNA expression in a relevant tissue under relevant conditions.
